1. Acceptance of Terms
By accessing and using the SDKSMS platform and services ("Service"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Global SMS Compliance & Legal Usage
You agree to use the Service in strict compliance with all applicable laws and regulations regarding telecommunications and data privacy in your jurisdiction and the jurisdiction of the message recipients. Below is a non-exhaustive list of key regulations across global regions. You are responsible for ensuring compliance with all local laws, even if not explicitly listed below.
North America
- United States: Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA Messaging Principles and Best Practices.
- Canada: Canada's Anti-Spam Legislation (CASL), CWTA Canadian Common Short Code Application Guidelines.
- Mexico: Federal Telecommunications and Broadcasting Law, Federal Law on Protection of Personal Data Held by Private Parties.
Europe (EEA & UK)
General adherence to GDPR (General Data Protection Regulation) and ePrivacy Directive is required across all EU member states.

- Local Telecommunications Authority regulations regarding Application-to-Person (A2P) messaging.
- Local Data Privacy and Anti-Spam laws.
- Requirement to obtain explicit opt-in consent from recipients.
- Prohibition of sending objectional, illegal, or malicious content.
- Sender ID registration requirements where applicable.
Strict Opt-In Policy: Regardless of jurisdiction, SDKSMS requires verifiable opt-in consent for all marketing messages. Failure to provide proof of consent upon request may result in account suspension.
3. Prohibited Content
You may not use the Service to transmit any content that is:
- Illegal, fraudulent, or promotes illegal activities.
- Harassing, threatening, abusive, or defamatory.
- Contains viruses, malware, or malicious code.
- Phishing or deceptive marketing.
- Adult content or gambling-related content where prohibited.
We reserve the right to suspend or terminate accounts found to be sending prohibited content without prior notice.
4. Account Security
You are responsible for maintaining the confidentiality of your account credentials and API keys. You are fully responsible for all activities that occur under your account.
5. Limitation of Liability
SDKSMS provides the Service on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, SDKSMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
6. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
